In economic terms, a “black swan event” is one that seems superficially insignificant and yet is later seen as the precursor to a great economic disaster. A ‘Harbinger’ is a person or event or thing that signals the approach of something of greater significance.

The final snowflake that causes the collapse of a wall of snow, is the black swan; and the evident, unsustainable build-up of the snow, is the harbinger; one is the event, the other the signal. This week the government of Australia signaled in a single act of totalitarian rule that it no longer abides in law, the consequence is now inevitable.

“I consider that Mr Djokovic’s ongoing presence in Australia may lead to an increase in anti-vaccination sentiment generated in the Australian community, potentially leading to an increase in civil unrest of the kind previously experienced in Australia with rallies and protests which may themselves be a source of community transmission.”

No, he did not break any laws. Yes, he was granted a visa to come into the country of Australia to compete in a tennis tournament, as he has done since he was a teenager, he has never since been refused entry. Until this week’s capricious, political, vindictive, and oppressive decision was made by an Australian bureaucrat, under the careful and silent eye of his Prime Minister, Novak Djokovic was always a popular drawcard for tourism in this nation.

Mr. Djokovic had a lawful exemption to be in Australia, he jumped through all the hoops of this pantomime pandemic, to the point where presiding Judge Kelly, who overturned the initial cancelation of his Visa, stated “What more could this man have done?

We now, therefore, find ourselves in a position in this nation that has governing officials rise above any law the land has. In effect, there is now no law governing Australia that would limit the power of government. Now, simply a ‘feeling’, that you may inadvertently be the trigger of someone else’s crime can punish you. Read the minister’s quote again and again and again!

That Novak Djokovic has a philosophical and personal position on experimental medical programs is not in question, we all do one way or another, but that his personal belief about it can influence “rallies and protests”, and ONLY when he is physically in the nation, is beyond stupidity. In an age of lightspeed transmission of information, the physical presence of an individual localised on a blue court with a bat and ball, in Melbourne, can hardly incite an unruly, pitchfork-wielding mob on the steps of Parliament House in Canberra. You should require just a little more than a hunch before you are legally permitted to ruin the life of anyone.

Incredibly, Australia has an original 1297 copy of the Magna Carta proudly on display in the nation’s capital, it is the single document that teaches there is no single man in this nation that is above the law, how do we respond now?

Now, where are the laws that prevent you from being treated as a murderer because your thoughts might provoke someone to kill? Where are the laws that protect you from being capitally punished because a government official doesn’t like the way you looked at him?

This event in the history of Australia seems on the surface completely insignificant, the questions to answer however are; Have we just witnessed a “black swan” in Law? Is this a harbinger of what is to come?
